MCS - ChargeBacks

Anybody out there getting a slew of MCS chargebacks lately. I just received 3 - 1 from 2011 and 2 from 2012. The most recent one from 2012 was from a bid approval work order received on Christmas Eve due on 12/26/12. Keep in mind MCS does not plow their homes so we could not access due to 2 feet of snow in the driveway. Tried to get someone on the phone for 2 days to approve a snow plow...no response. Finally on 12/30 I decided to plow the driveway on my dime in order to get my truck up to the property and complete the order and we invoiced the job on New Years Eve. MCS a year and a half later decides to whack me a $290 fine due to not completing the order in a timely fashion resulting in a delay in conveyance to HUD. ABSOLUTE CROOKS been working with MCS since 07 this was the last straw all done with them.

There has got to be something legal wise that limits amounts or timeliness on charge backs.

That is the ultimate in BS there.

Who the hell do they think they are.I Would never allow someone or Company Ever come after me for a job i did 3 Years ago.I Lawyer up! Here the county license you must gurantee a minimum of 1 Year.That's all i will Guarantee.Do they owe you money?This should be illegal

They will claim they were tagged during a HUD audit/review and are simply passing it on to you. My experience has been that it doesn't hold up in court, but every judge is different.

I had something similar a while back but not with the same company, they tried to back charge me from 2 years prior.
Simply put I explained that either they provide me proof of why or we would be
1. Filing charges for theft by deception.
2. Have wire fraud charges filed since if they were indeed trying to back charge with no proof then they were committing fraud using the internet (same as fraud using the US Mail).
It took a little while for them to realize what I did for a living before I got into this field. Once they realized I was a former detective they all of a sudden realized that it was for another contractor and not us.
Ya right.
Funny thing, we never received another order from them. lol

Basic contract negotiation
1) offer in your case BID
2) Counter offer if applicable
3) Acceptance

There is a legal time that a person should be able to come back and change or negotiate the final price .

They tried to do this with me over a wint and the pump water filter basket was on so tight that I could not get it off. They were made aware of this and I even put it in my notes and a bid was put up. Low and behold t hey said they were going to back charge me 250$ Great " I DON'T WORK FOR YOU ANYMORE " Well we shall take you to court. Great you'll spend more money than its worth. So you're not going to pay she said? NOPE GOODBYE was my final word with them

Them saying that it didn't convey is on their hands. You can show that you tried to call and they were shut down. Even if you had done the work on their timeframe it sounds like no one was there to QC it anyway so whats the difference ??
