In regards to the big issue of this past week...Background checks and the software on your phones...
I have spoken to several people and I have some questions that I would ask...I would not recommend that anyone just blindly agree to the conditions that have been asked of you or your company....Hope this helps you guys make a good decision....

First I would ask the following about the software....

Source codes for the software should be provided for the tracking software that contractors are being forced to install on their personal cell phones or provide an alternative program.

As for the checks on everything else...Let's be real...the Government does not ask IBM, Lockheed, Microsoft for a list of personal information on their employees when they are awarded a contract...I'll bet dollars to donuts that PKMG dod not have to submitt everyone of their employees personal information to get the HUD 3.6 contract....
These are the questions...at the very minimum I would be asking...

1. When the working relationship is severed between the Contractor and the NPOM How long is the NPOM allowed to retain this information?
2. Why are Social Security numbers being requested? Should the government or any other organization for that matter contract a company like IBM they surely would not demand that IBM provide this type of information on their employees. In addition when one hires a company to perform a service a company does not have a Social Security number, they have an, EIN, TIN, DUNS, NAIC, that identifies them. Providing this type of personal information blurs the line between Employee and the spirit of the Independent Contractor rules.
3. Is the background check criminal or a credit check?
a. What type of information will disqualify a Contractor from being eligible to accept work orders?
b. Who has access to this information?
4. We ask that the NPOM provide for review the security protocols to secure this information. At this time none have been provided. With work orders passing through the NPOM, to sometimes two or three ROM’s providing this sensitive information without security measures in place is absolutely unacceptable.
5. In the event of a server breach and information is lost;
a. Are the Contractor’s cover for damages by the NPOM’s insurance?
b. Are the Contractor’s entitled to be notified?
c. What is the procedure for said notification?
d. Who will be responsible for cleaning up a Contractor’s credit issues should identity theft occurs?
6. We also maintain that ROM’s NOT be allowed to demand this sensitive information and in turn pass the information “up the ladder” Should the NPOM require such information the NPOM must coordinate directly with the Contractor’s to obtain this information.

Our company flat out refuses to provide this information for the simple fact companies do not hire our employees they enter into a contract with our company...We have an EIN # and that's that.....

From the UEID in Nevada...........

Here is what the Nevada Unemployment Insurance Division said....I reviewed this with my supervisor and unfortunately, we don’t have any jurisdiction with this issue. She suggested that you contact the Labor Commission, or even an attorney for guidance with this issue....off the record...she does think it crosses the line

I just got off the phone with the Labor Commissioner here in Nevada...they have stated that this is so convoluted that we need to consult an Employment Attorney......I knew this was not good...

Great information! Things get more and more ridiculous everyday! When are we (the contractors) actually going to become relevant major players in helping get this business straightened out and respectable? SMH

The NPPG is in currently putting position papers together on the subject. and they are also accepting members...
But there has been "white Papers" published by foreclosurepedia on the matter...
The position papers on this topic should be out the first of next week....
